Legal Question in Family Law in Texas
Military Divorce Pension Division & SBP
Almost 30 yr marriage, separated over 8 yrs, 18 yrs military service during marriage, retired at 20 service. Can a military pension (biggest community asset) be allocated disportionately based on fault? How can ex be removed from SBP? What defense is there against a hypocondriact ex who claims too sick to work & wants lifetime support (was painting fence this wk)? She has not answered despite personal service in Calif (where family home is) & husband is planning pro se default divorce 1st week in June in Denton County (unless can find atty with military law expertise). He is willing to give up all equity in home (30k total) & most personal prop. Thanx.
