Legal Question in Family Law in Texas

military retirement

My spouse was awarded 50% of my military retirement after 16 years of marriage. I am wondering if she remarries or if she doesn't, if there is any way for me to request to have the military retirement returned to me? Additionally, I am going to retire in PA. If she remarries she might leave the original jurisdiction, so if I request through Court would I do it in PA. I am remarried as well. I would be happy to provide more information if needed. I am presently in GA still in the military.

Re: military retirement

You don't say where you were divorced, but in Texas once the divorce is final the property division cannot be reopened. If you didn't like the property division, the time to have fought it was during the divorce. Even the military agrees, if she was married to you for all those years while the retirement was earned, she is entitled to half of what was earned during those 16 years.
