minor child name change

I have 2 boys, ages 11 & 12, and their father hasn't seen them in years. I have a signed and notarized copy of ''Fathers Affidavit For Voluntary Relinquishment of Parental Rights'' that he had sent to me in August of 2000. He does not pay child support. My kids do not want his name. They want to change their last name to my maiden name. Is this possible? This is all my oldest son thinks about and he has a letter written about 4 years ago to say why he wants his name changed. Please help!

It is unusual for a judge to terminate a father's rights, without a stepparent to fill the shoes financially and emotionally. It is not impossible. You may have the case where the judge would approve a termination. It is not something that you could likely succeed at on your own. You need to retain an attorney.
