Legal Question in Family Law in Texas

Minor child name change, father's location unknown

I live and work in Nevada, I met my son's father in Texas while on a temporary work transfer. My son was conceived and born in Texas (father's name on birth certificate and given to child). We moved to Nevada 2 months after my son was born on a transfer back to parent company. Shortly after my son turned 1, his father moved out of the residence. I have supported my son's needs (financially and emotionally) on my own from day one. I have not heard from his father nor has he seen his son in over 3 years. Last I heard (third party information) was that he remarried and was planning to move out of the country on contract work (computers). My issue is I have to constantly prove that I am his mother to my employer to insure him, insurance for coverage and doctor's offices for check ups. My son just turned 4 and will be starting school in the next year or so. How can I go about legally changing my son's name to mine? Does it legally matter that he was born in Texas? Does this kind of name change take very long in court? Since I, nor his friends (or so they say) have any idea where he is, can this be done without him since he has been gone so long. Please help...

If there is no court of continuing jurisdiction in Texas, then file in Nevada.

You need a Nevada attorney to answer your question about contacting the father.
