Minor's Name Change

How to change a childs last name on a birth cert. Guy listed as father is not able to be found. She is 16. I (we) have been together since she was about 3 and I am daddy to her and not the other guy. Her last name is--name removed--on all her records except her birth cert. How can we legally change that? Is a possibilty she is mine but we were not together when she was born. When my daughter was born this guy took off 1 month later. Found him once in 1997 when I got out of the USMC but he was in prison. Will not talk to us or return any letters. She is my only one, please help or point me in the right direction.

You cannot change her name on the birth certificate without his permission. Sounds like you could adopt this child, but he would still require legal notice.
