Minors requesting marriage w/out parental consent

Expecting parents just turned 16. They want to get married and live w/16 y/o boy's family. Girl's parents object to marriage and will not sign for them to be married. 16 y/o expecting parents hired boy's uncle to represent in court and gave girl's parents 3 day ultimatum to allow marriage or be subpoena'ed to court. The boy's mother is on 4th marriage, father on third marriage. The girl's parents have been married for 31 years -only marriage. Expecting parents inmature, in 10th grade, make approximately $400/mo. The boy's family has 4 dependents and 1 away in Navy. The boy's family income approx. $60, 000/year. Girl's parents 1 dependent (her) income approx $75,000/year. Do you think judge will grant petition for non-consenting marriage of minors? Thank you for your help. -mpat

I certainly hope he doe not grant the petition. Go read the statistics. 16 year olds with essentially no income getting maried to "do the right thing" and one set of parents oppose marriage. The probability of divorce is almost 100%. Prior to the divorce there will be problems which may drive an unbreachable wall between the perants.

Why not determine paternity in court, set up child support and possession rights, and if the parents still want to get married in 3 or 4 years, then they will already have their family started. In the meantime the baby (the most important person in this situation) has a chance to develope a relationship with his / her mother and father without the pressures of a crumbling marriage.

Just a thought after 30 years of law practice.
