Legal Question in Family Law in Texas
Modification of Child Custody after divorce
My exwife and I got back together (dating, not remarriage) and are splitting again. I want custody, but am not sure how to go about it. The prior customdy arrangement showed her as the primary custodial parent, with joint custody. I want to be the primary custodial parent due to many changes in her life (alcoholism, diagnosed major depression). Her family has loads of money to throw at a court Ccase, I don't. How do I win here? It's about my five year old son, not winning or losing, simply looking out for him. I don't want to take him away from his mother, but I don't feel she is fit to make any serious decisions regarding him with her condition. She refuses to work and blames her deep depression for that, although I have asked her to get a part time job for something to do and for her self esteeem, she says I told her she would never have to work (before the divorce, right after our son was born, not recently).
I am worried for his safety. When she was always drunk (she has driven drunk with him in the car, gotten drunk with her being the only person with him, seriously injured herself while drunk and he was behind her and she pushed him out of the way right before she landed on the back of her head, slicing it open). Help.
