modification of custody

My 12 (almost 13) year old son wants to come live with me. My Ex and I have joint custody, but he resides with him. Now I am remarried and moving to another state; my son wants to live with us. How do I go about doing that?

You may file a "Suit Affecting the Parent-Child Relationship" (SAPCR)wherein you will ask the same court that issued the original conservatorship order to amend it. A party may seek to change previous orders of this type if specific period of time has passed since the last order, or because of a substantial change in circumstance. Your moving to another state may qualify as a such a change. Your son may also have his wishes known to the court by filing a Minor's Choice of Conservator." That said, the easiest thing to do may be to ask Dad to allow the boy to live with you. Good luck.
