Legal Question in Family Law in Texas

modification of divorce decree

I have been divorce for 3yrs and my divorce decree states that I must stay within the state of Texa with my children, but the father only sees them once a month if that. It's like he only sees them when he remembers he has children. He is also behind on his childsupport. My husband's job has offered him a job in another state. Can I get my decree changed as to where I reside? I am not a crminal and don't feel it is fair that I have to stay stuck in one place because their father's self motives. He does'nt even see his children on a regular basis let alone what is ordered by the court. Can I also get his visitations changed to once a month seeing as how he chooses to see them that often anyway. If he does'nt take advantage of his visitations while he is in the same city what would it matter if we move to another state? My children are 8 and 5 and they don't even ask for their father, infact,my 5yr old son has stated he dislikes his father because he does'nt help me with them.I have never denied their father his right to see his children. Even though he is behind on his childsupport I still allow him to pick up the children as he pleases despite eeryone else telling me that I should'nt seeing as how he does'nt follow the courtorder.

Re: modification of divorce decree

You would need to modify the divorce decree.

If your ex agrees to the move, it will be pretty simple.

If he chooses to fight your move, then it would be more complicated.
