Legal Question in Family Law in Texas
modification
I am a father who is on child support and am looking to try to take my daughters mother back to court because she is refusing to let me see my child on my weekends and is having a drug problem that I feel is endangering and compromising my child. Any type of information on if it may be possible to get a modification would be greatly appreciated. Thanks

Re: modification
You need to document at least three times that she did not allow you to see the child (that means you were where you needed to be according to the Order when you were supposed to be there). No matter what she says or tells you before hand, you not showing up at the time and place specified in the Order is you waiving visitation, not her denying visitation. A non-relative witness to your appearance / her non-compliance can really help your case. So can any proof of her drug use. If or when you have this, call my office for a consultation and we'll talk about filing an enforcement and/or modification of custody against her.
