Legal Question in Family Law in Texas
Modify Child Support
I am searching for a way to help my brother to file a motion to modify his child support. He pays child support to the mother of his two children, one is 18 and the 16 year old was sent to live with him as soon as she became pregnant. At this point he cannot afford an attorney to take care of this for him as he is taking care of all of his daughters expenses and still paying her mother child support. Can you please give me some information on how to file this on our own? we have no idea what form to file or how to obtain it. thank you.....

Re: Modify Child Support
The child support for the 18 yr. old ends at 18 or when she graduates from high school. Unless, the child is permently disabled, and it can run longer.
If he has no money, perhaps he will qualify for free legal assistance in his community. He needs to call the State Bar of Texas in Austin, TX (or email them) for a list of free legal assistance in his community. Or call local law school and see if they have legal clinics.
If the 16 year old is pregnant, the father of the baby can be ordered to help pay maternity costs and then child support.
There are forms available in law libraries of law schools and county law libraries. After looking at the forms and steps needed to obtain a modification, I think he will decide that it is worth hiring an attorney to do this for him.
Best of luck to you.
