Legal Question in Family Law in Texas
Modifying Right to Establish Residence and Support
My ex-husband has custody of my daughter (14) and son (10) and I pay child support and my wages are garnished. My daughter now wants to live with me and her father is agreeable. Since we would each have one child we determined that neither would be responsible for child support. If we are agreeable to everything do we really need to contact a lawyer (I called one and was given a fee that was even higher than the cost of the divorce)? Aren't there just some forms we can fill out?

Re: Modifying Right to Establish Residence and Support
In my opinion, you should have an attorney to make sure thta you comply with all applicable laws and rules. This does not have to be expensive unless one of you wish to make it so. Depending on the circumstances, this should not take more than two or three hours.
The attorney CANNOT represent you both. Either both of you have to have an attorney or one of you needs to be represented.
