Legal Question in Family Law in Texas
Mom and dad get divorced and share custody of child. Mom has another child and she gets sexually abused and cps suggests that mom gives kids over to grandmother for a while. Grandmother files for custody agianst father and mother leaves the picture. Dad and grandmother get social study done and dad wins but before going back to court he let mom see daughter ONE time at his house suppervised by him. Dad thought it was okay as long as it was supervised by him. Court awarded temporary custody to grandmother. 3 years went by and no final hearing was done. Case gets dismissed but nobody new about it. Dad tells grandmother and she starts a new case and judge gives the child to grandmother again and only gives dad 1 weekend a month. Dad has no criminal background. He is a prison gaurd. Has been married for 7 years, has another daughter and a stepson. Sutable living environment. Why does a grandmother in texas have more rights that a father does? How can dad get daughter back or can he since daughter is 12 and grandmother spoils her and she doesn't want to live with dad now.
