Legal Question in Family Law in Texas
Mom gave up and sent daughter to live with her dad. Now she wants her back. How can dad keep her?
About three weeks ago my stepdaughters mom called and said she couldn't handle her anymore, and asked if she could move in with us. We got her enrolled in school and everything, now her mom is saying she wants to move back after spending the weekend with her. Daughter has never said anything about wanting to go back to us.
Daughter has had history the last couple years not getting along with her mom. We are told that when they fight her mom pulls her hair, locks her in the room, or even locks her out of the house when she tries to run away. Her step dad spanks her (supposedly when needed) and they give all of her toys to siblings as punishment. Herself and her mother are seeing counselors. Daughter has been told that she has "anger issues", however:
We have no issues with daughter while she is staying with us. She has been asking to live with her dad for several years. Her m om has a history of being very manipulative. She sent her to live with us, but no legal custody changes have been made. After the weekend with her mom, daughter tells her dad that she was only sent to live with him to learn a lesson.
This is not healthy for our poor daughter! What can we do?

You need to file a motion for modification and ask for temporary orders. Plan on giving a lawyer at least $2,500.00 up front.
