Legal Question in Family Law in Texas
No money for a lawyer
I do not have the money for a lawyer. I have some questions to be answered some of them stem from me reading other topics on this site.
1. He is working out of state and I am in Texas. Can he publish in the paper that he is filing for a divorce instead of having papers served? 3. Also, if he has a union pension which I'm not sure that money is added to as of now because I don't know how it works, he has been working non-union lately,Idon't know if his present job takes out anything or does that matter? am I entitled to any of the pension?
4. He says what's his is his and mine is mine. Originally we had a checking account with both names (he has others and credit cards, ect in his own name),it was to be used for both of us to add money to, to pay bills, He has never written a check on this account, not because I didn't allow this, but he considered it to be my account. Is all of this community property? I know he also has a cash box that he keeps with him. One time it had almost $10,000 in it. I appreciate all the help I can get.
thanks

Re: No money for a lawyer
IF the divorce is filed in Texas, then all property acquired after the marriage is community property (unless by gift or inheritance). Property acquired before the marriage is separate property unless it has been so commingled with the community, that it has become community property.
He can have you served by publication if he convinces a judge that he does not know your whereabouts, and attempts to serve you are unsuccessful.
You might have a claim for temporary spousal support, and temporary attorney fees.
Many areas have low cost legal services. You also may qualify for filing by indigency. Many attorneys will also work on a payment plan. You may want to check out these as alternatives.
