Legal Question in Family Law in Texas

Name Not On Mortgage

My husband has filed for divorce. Ex-wife's name is on mortgage. She lived in the home for two months. I lived in the home for four years. Am I entitled to any equity in the home?

Re: Name Not On Mortgage

Whether or not the exwife has a title interest in the house is determined by their divorce decree, not by the names on the mortgage. Since he had the house prior to your marriage, it is probably his separate property. The community estate (half of which is yours) may have a claim to reimbursement from his separate property.
