Legal Question in Family Law in Texas

My mother has Alheimers and is in a nursing facility after my Uncle gained guardianship or so he says. He has refused to tell me where she is and says I may not visit her. And threatened me with arrest if I tried. I don't even know how he gained control I was not informed. He also disposed of all her possessions. How do I fight him. This occurred in Azle, Texas

Start with the Probate Court in the county where Azle is located. Many courts now have the records available online. If not, call the clerk's office, and the clerk should be able to locate your mother's name and determine if a guardianship exists. If so, you can learn the terms of the guardianship, and contest it if warranted. If your Uncle is the guardian, he has duties and responsibilities not only to your mother and her estate, but to the court. If a case exists, consider retaining an attorney to investigate and contest it. If not, you can file for guardianship yourself anyway.

I'm sorry that you are going through this.

I agree with Theresa Langford. You definitely need to consult with an attorney as soon as possible. You need an attorney that does elder law and/or probate and/or wills.

I would "Google" these areas of the law for the county that your mother lives in. Look on this website and on www.avvo.com, You can also look on the State Bar of Texas website too for an attorney.

You might need to join a support group to gain strength for yourself during this difficult period. There are many resources out there. Look for an Alzheimer's group in your area.
