Legal Question in Family Law in Texas

can a mother get back custody from grandparents

Feb. 2000 I was incarserated. My parents sued for conservativship. I missed the court date because I was in jail. They then filed for a permanent order and had the papers served to their house, where I did not live. They new my address. They signed for the papers,so I was never notified of the hearing. I found out about the order through a lawyer I was going to use.I didn't know I was orded to pay child support until June 2001. I love my son very much.I'm not a mother who doesn't care or neglects my son like many others. I'm lost without him .There is much more to my case. I need a lawyer who can represent me to the fullest.Everyday it gets worse on both me and my son.

From what you've said, you were not properly served with notice of the litigation. This will give you grounds for a rehearing. If you live in the Dallas-Fort Worth area, call me at 817 763 0600.

To win custody back, you will need to set aside the prior order either by argueing that you werent given proper notice of the last hearing or by filing a motion to modify argueing that circumstances have changed and that it be a positive improvement for you to now have custody. If you like to discuss that matter further, and live in north Texas, call my office for an appointment.
