Legal Question in Family Law in Texas

If my mother bought my husband and I house with the intention we were to make payments but she passed away a month later and wiped the debt clean from our names and the house is in both our names but he never paid a dime for it and she even had to pay him to do renovations on his own house do I still have to give him half the house in the divorce? We live in Texas and he lived in the house in question for almost 3yrs.

Is the house deeded into BOTH husband and wife? Are both spouses shown as grantees? It makes a difference.

If she gave the house to both of you, then you both own it. It is not community property and the judge cannot divide it. Check the deed to be sure.
