Legal Question in Family Law in Texas

My mother has cancer and does not have long to live. i have an 11 year old brother and we do not share the same father. his father has said that i can have custody over him when my mother passes and will not fight me on it. i live in the state of texas. what is my next step to get custody of him? what is the process?

File an original petition; it would be "joined" by the mother and father, that is, they would sign on as petitioners. You'd file it in the county where you and your brother live. The petition would ask that you be appointed sole managing conservator of your brother, and it would spell out the reasons.
