Can a mother get charged with kidnapping if she leaves an abusive marriage and leaves the county, but the father knows where she is at?

You can be charged with anything. Conviction is another matter.

You cannot kidnap your own child. However, if there is a court order governing possession, you may be violating that court order and risking contempt charges.

If there is an abuse problem, I suggest you go to a domestic violence shelter.
