Mother and child in CPS custody
A mother and her child are in the costody of CPS and staying at a shelter. The husband made a threat against the mother and baby, the police were called and he was taken to JPS. He was released and is not in jail. The mother let the husband return to the home and CPS met with the family and some friends to discuss the situation. They determined that the husband was a threat and took the mother and child to a shleter. He is not in jail and is not going to any therapy or treatment. Can the mother and baby not stay with family members? There is a restraining order against the husband. What needs to happen to get the mother and baby out of the shelter? What rights does the mother and the baby have? Can CPS keep the mother and baby in the shelter indefinatley?

There are a number of things here that don't make sense, the least of which is the fact CPS does not take custody of mothers, just children. I suggest the mother get an attorney of her own as soon as possible.
