Legal Question in Family Law in Texas
Mother is deceased..Texas Dept. of Famiky and Protective Services granted managing conservatory to an aunt.(who lives in San Antonio) .Dad was incarcerated and has possesory conservatory... He has been released from jail and now wants to move the child to Fort Worth, Texas to live with him and enroll in school What rights do he have (education/Custody)
1 Answer from Attorneys
As it is, he has very few. He could file a Petition to Modify the Parent-Child Relationship and try to become the sole managing conservator. Whether he is successful in that effort will be very dependent upon the facts in his case. It would be best to consult with an attorney in the county that granted the grandmother her rights. If that's a Fort Worth court, then I would suggest either consulting with Greg Housewirth in Fort Worth (www.lawtolife.com) or with my firm.
