Legal Question in Family Law in Texas
What can a mother do to defend herself from the father of her child that is trying to get a Ex Parte Restraining Order? and trying to file a SAPCR?

Not much other than hire a good family law attorney to defend you. The father has the right to file his suit and to ask for an Ex Parte Temporary Restraining Order. Most TROs are going to be granted. The purpose of the TRO is to keep the status quo until there is a hearing --- no taking the child if you are not already in possession or hiding the child from the other side, no turning off utilities, no destroying mail or changing insurance --- the terms and conditions are spelled out very clearly in the TRO. A TRO is not the same as a Protective Order. It only lasts for 14 days or until the first hearing is held, although if the hearing cannot be held within that time it can be extended.
