Mother in law kept the support, we had the child

My mother in law had legal custody of my stepson and allowed him to move in with his mother and myself. After six months off the child being in our care, custody basically reverts to mom. Mother in law refuses to send us any of the child support. We are now in a position to petition to modify conservatorship. Is the mother in law liable for the child support she kept and, if so, what codes apply and can we press a civil suit without having to press criminal charges?
