Legal Question in Family Law in Texas

My mother just passed away. She and I have debts. My brother has basically been estranged from us. How can I make sure, if something happens to me, that he is protected from our debt and I am protected from him being notified or asked aything regarding me?

Debt cannot be inherited. Unless you co-signed or guaranteed your mom's debts, you are not responsible for them. The same goes for your estranged brother and your debts.

The fact that your brother is not liable for these debts will not prevent debt collectors from contacting him. This involves controlling the behavior of others, something that is beyond the power of lawyers.

Nor will it prevent him from paying money he does not owe under the law.

The best way to protect him is to notify him, so he will know how to treat any collection efforts.
