Legal Question in Family Law in Texas

I am a mother of a five year old boy i share custody with his dad but i am looking into getting either supervised visits of full custody. every time my son goes over to his apartment he come home sick or with bug bites all over him. the most recent problem took place over the Easter weekend i granted his dad with an extended weekend and he has a fiance who live with him and has kids they live in a one bedroom apartment and this weekend they had my five year old son sleeping in a crib he hurt his head somehow nobody knew how he did it the other side of his face was swollen and his daddy refused to take him to a doctor i was in west texas handeling a matter with my fiance we headed back last night upon arrival to his dads apartment i saw the head injury and swelling was gone after i got him home i put him to bed the following morning i took him to his doctor where she found he has scabbies .. do i have a case?

If the current setup in the visitation order isn't in the child's best interest, and a change in the order would make an improvement, and you have good evidence of this, then you can get a modification of the order. I hope you've been keeping good records, something like

March 18, 2012 (6:45 pm) - Andrew brought him back late again. Visible bruises on the child's legs (I took photographs). I asked Andrew about the bruises, and he just shrugged and drove off.
