im a mother of a 2 year old me and the father where never married i was just married and me and my son do not have the same last name how do i go about changing the name even though the fathers name is on the birth cert but he has not been in the childs life for over a year and does not support him

You can ask a court to change the name of a minor child, but you have to serve the name-change petition on Dad and give him an opportunity to object to it.
