Legal Question in Family Law in Texas

what motion to file for venue change

My X lives in Collin County yet has been doing all her procedings for child support in Dallas County, I was told that she has to file in Collin County. I would like to file a motion to have all past rulings voided and transfered to Collin County where I also reside.

What motion do I file if this is possible ?

Where do the children reside? Mr. Grissom is correct, venue is not a jurisdictional issue, and does not void the earlier orders. If the children are in Collin County, you can file a motion asking the Court to transfer the case to Collin County. You need to research the law, or retain an attorney as there are specific procedural requirements. Also if your case is being handled by the Guardian ad Litem's office, changing venue will not realistically change anything, since it handled by the same office in both counties. TCL

Re: what motion to file for venue change

Apparently Dallas Co. issued the first orders on the children and can retain jurisdiction. The other choice would be where the children reside, but it is usually the choice of the JMC with primary custody/ Orders are very unlikely to be voided and Collin Co. appears to have no jurisdiction from your language in the question.
