Legal Question in Family Law in Texas

motion to modify custody

Is there a form on line that I can use or does this have to go through the courts? The agency that I am trying to get him into is acting like it is not that entailed to get done. I am on a very tight timeline to get him in for the program starting in early January. Thanks!!

I strongly advise against buying an online kit. If it's from CA, FL, CO, NY or WA -- don't waste your money.

Also, Legal Zoom's family law kits don't work in Texas -- they might have a good estate planning document but I've never seen it so I can't comment. I've their their divorce kit and it is NOT designed for the State of Texas!

I offer do it yourself kits that are easy if everyone signs. You just walk it through. Both parties would have to appear and be willing to state to the Judge under oath that everything is agreed to.

You need a certified copy of the current court order and then I can prepare the modification.

How much? It depends on how much work there is to do.

I estimate $500 cash at the time we meet. Then you pay the county for their filing fee.

If you want me to go to the courthouse with you, then around $700.

Courts are on skelton staff around Christmas but in Harris County, there is always at least one judge around signing uncontested matters.

If you live in a rural county, then it might be totally different.

I don't know if there is an online form -- should be somewhere. Does it have to go through the courts? That's how you got custody and that's where it has to be changed. Entailed? Not if you know how to do it, but I would be very surprised if you could get it done before the end of January. Most courts already have their January calendar full -- some up til March or April. Good Luck.
