Can i move with our daughter if no divorce has been filed?

Can I move out of state with my minor daughter if no divorce papers have been filed yet? He moved out of our house 1 month ago. I want to get a better job?? OUr daughter is 6 years old

If there is no court order concerning your relocation out of state, you can go wherever you wish. If he should file for divorce in your home county, you might be required to return to contest the divorce for custody and property division.

Legally you can move. However, if you do and he files for divorce here your actions can be perceived as hiding the child from the father and could cost you custody. I do not recommend it. If you have more question feel free to e-mail me. I practice in the Houston area.
