want to move out of state with child

My boyfriend and I live together with our son in Texas. I want to end the relationship and move back home where my family is in Kansas. When we go to court for custody can he make it to where I cannot move out of Texas and if so is there anyway I can fight it.

You can move with the child to Kansas but you have to file it with the court.

Since you are not married, the proceeding would be a Suit Affecting Parent-Child Relationship. Judges are very reluctant to allow the primary conservator to move out of the area of the residence at the time the matter is filed.

Is the matter already filed?

If not, you can leave to Kansas with your child, but if the dad promptly files in the Texas court, the judge will probably make you return with the child, since you will not have established residency yet in Kansas. (those are questions to ask a Kansas lawyer).

The best way to handle it is to hire a lawyer.

Get an attorney to assist you with the divorce and that is the best way to improve your chances of keeping your child.
