Can he move out of state with kids?

I have recently asked my husband for a divorce. He was a stay at home dad/unemployed for 3 years but recently went back to work. He has indicated that he wants custody of our sons and wants to move back to St Louis to be near his family. I would like shared custody of our kids but to stay in Texas. Does he have any legal standing to have the ability to move the kids out of state if I do not agree?

If I were you, I'd file for divorce immediately and ask for temporary orders.

Ask the Court to limit him to living in your county with the kids.
