Legal Question in Family Law in Texas
I moved out of my home to my moms home with our soon to be 3 year old daughter. My now ex and I also have a 9 year old son. He chose to stay with his father he likes his school and friends. If my ex were to file on me for child support with the kids split up will I have to pay. As of now he's not working much and living with family close by. I help buy food and support for my son.

Probably.
The way I would do child support in your case as follows:
1. Figure out how much he would have to pay YOU for the one child. Say it's $200 per month.
2. Figure out how much you would have to pay HIM for the other one child. Say it's $450 per month.
3. Subtract the lower number from the higher number, eg $450 - $200 = $250.
4. You would pay him $250 per month.
NOTE: That does *not* take the cost of health insurance for the children under consideration. That would be a very important issue that might change the numbers significantly.
You can calculate guideline child support at http://www.jdreview.com/cscalc.htm.
Good luck!!
