**Moving Back Home**

In the divorce decree, I was awarded the home. For almost 3 years I was paying the house with no problems until my ex-husband stopped paying child support resulting in my income changing and past due house payments. During this time, I got so far behind that I was facing foreclosure. My ex-husband then informed he wanted the option to catch up the payments to prevent a foreclosure on his credit (home is in both of our names), but, I had to leave the home. Since that time (approx 4 mos ago) he has allowed someone to rent the home without a signed legal contract. Since then, I have filed for child support & is now receiving enough income to make the house payments and move back into the home. I informed him to give the tenants 30days to move out, and he has declined to do so. What action do I need to take in order to have the renters moved out so that me & my child can move back into our home & get it refinanced in my name?

You need an attorney, in fact you really needed one back when he first quit paying his child support. Hopefully, a good attorney can help you untangle this mess and get you back in the house. Any refinancing is between you and the lender, but again, the time to have done that was before you got behind on the loan.
