Legal Question in Family Law in Texas

moving out of county with child

My husband and I have filed for divorce but not yet set a court date but have waited the mandatory 60 days. We filed uncontested with children. My question is our lease is up and I moved to San Antonio to goto school at UTSA and to live with my mother with our child. I need to know if I need to do something since I moved out of county or do I need to move back until our divorce is finalized? My husband still lives in Harris county, Texas but also moved out since our lease was up.

Re: moving out of county with child

If you have both signed an Agreed Final Decree of Divorce, one of you needs to go to the courthouse in Houston and prove it up. No one needs to move.

One of you will need to go to court and under oath ask the judge for a divorce. One of the questions you will answer is that you lived in Harris County on the date the lawsuit was filed. It is irrelevant if you moved since you filed the lawsuit.

Good luck!

If you need help, let me know. I do a lot of DO IT YOURSELF legal kits at reasonable rates.

If you have no idea about what to say to the Judge then you really need to talk to me!
