moving out the house with children and leaving the country in mutual agreement,

I have been married for 18 years, by mutual agreement i can take my children to my country of origen mexico, if i leave before divorce settlement, do I loose the half that correspond to me?

I presume you are talking about the community property. The property is fixed at the time of separation and you would be entitled to your half. Realistically, however, it is very difficult to preserve your property in your absence. Your spouse would be responsible for any losses, but if he needed to trade-in for a new refrigerator or something like that, then all sorts of problems of proof arise. In the divorce court, each party is required to submit an inventory and that is what is divided in the divorce. If there is something of great value that you want, you should take steps to protect that property when you leave.
