Legal Question in Family Law in Texas

Moving overseas

I am immigrating to Japan with my son and long-term boyfriend. I am worried that my son's father will petition. He has not helped in raising the child. There has been no legality issues regarding custody. His name is on the birth certificate. What can he do to stop me from going? What can I do to avoid this or rectify this situation if it comes up?

You need to go sit down and talk with a good family law attorney. This needs more than a quicky email answer.

Re: Moving overseas

If the existing court orders do not have any geographic restrictions on where the child is to reside, you can move. However, the order probably requires that you provide notice to the father and the court that you intend to move - you need to do that. He may elect to file a request with the court to halt your move - I suggest you anticipate that happening and decide gather the information you will need for court.

It would be wise to hire a lawyer to assist you.
