moving out of state with minor child

I am an unmarried father who has raised my seven year old son since birth, while living under the same roof as his drug addicted mother. I would like to relocate to another state with my son. There are no legal custody papers on file as of yet. What course of action should I take to assure that my son is protected by my custody of him? His mother is not capable of caring for him, but still threatens that she will not allow me to raise my son.

The court will decide which parent is the best person to have primary possession of the child. The judge will consider the history of the parties and the child in doing so - that means the parent who has been primarily responsible for taking care of the child will be favored in a trial.

I suggest you hire a lawyer.
