Legal Question in Family Law in Texas

Moving out of town.

I have joint custody but am the custodial parent, can I legally move out of town without the consent of the other party? I would be moving more than 100 miles away.

Re: Moving out of town.

Based on what you have written, it appears that you can move anywhere that you want. Generally, within the decree there will be specific terms regarding child(ren) custody and residence requirements. You should seek the assistance of a local law firm to review the specific terms. If my law firm can assist you with this legal issue or any other legal matter, please contact my legal assistant Jennifer ([email protected]) to arrange for an initial consultation.

As long as you don't plan to take the children with you. Your decree should have provisions regarding changes in visitation when the possessory conservator moves more than 100 miles away. If your decree has other restrictions, you should have it reviewed by an attorney.
