Legal Question in Family Law in Texas

NC Parent now in jail

My ex is now in jail. first offense was assualt w/ a deadly weapon, he rcvd probation. 2nd offense is unauthorized use of a motor vehicle and his probation was revoke. He is is in Burleson/Waller Cnty. I was told that was 3 felonies for him so he may not be coming out for awhile. he has never paid cs. I have not set up the account for CS to be sent to me from him because he won't pay and Harris Cnty does not help collect. I was told that when he goes to trial and they see he has not paid the state will start sending me CS. Is this true? If it is, how do I go about finding out more infor. Also how hard will it be to have his rights terminated now that he is in jail? I am thinking about it but my dghtr is 15 and he has not seen her in 4 years so it may really be a mute point.

Re: NC Parent now in jail

The state is not going to send you child support other than what might be based upon his earnings while in prison. A judge might terminate the parental rights of a person who was going to spend the rest of their life in prison. You have to file a petition to terminate.
