Legal Question in Family Law in Texas
Please, I am needing feedback on what we should do. Our 4 small grandchildren were taken from our daughter and significant other in Sept 2008 and we got them from CPS in Oct. 2008. They worked with parents to try and rectify problems and even though they had doubts recommended return 1 at time and judge agreed. The baby was sent back and we were called to go back and get him less than one month later. Since then the parents have again lost all utilities and got kicked out of the house they were in due to not paying. She refuses to work, he works as little as can and multiple other issues. The kids are happy and healthy here with us and have told everyone from the beginning they don't ever want to go back. CPS had final date extended past the year due to her being pregnant again-she later miscarried and final date coming up soon.They are seeking termination with us to adopt. The hearing coming up is for termination-CPS is trying to convince them to sign papers earlier for their advantage is plan to have furter children,etc.but don't know if they will. Even their lawyer told them they didn't have much chance of ever getting them back and that was before they got kicked out of their house. Our immediate CPS worker who comes every month said that there is no reason for us to get a lawyer as we are the ones seeking termination-CPS is. The other CPS person says we might should have. Now, we are trying to keep everything as civil as we can as we want the kids to continue to have some contact with their parents and getting a lawyer involved could cause extra hard feelings not to mention the cost involved and with 4 new people involved our costs have already taken a huge rise. We do not want the kids to ever have to go thru any more disheaval, they've been thru enough but don't see the need for a lawyer. What are your thoughts? Thanks!

An experienced attorney can provide you with an independent point of view. CPS is involved in the case.
Based on what you have written, anytime CPS is involved in a case the parties within the case should always consider consulting with (at a minimum) or retaining a law firm to assist them. CPS is a representative of the State and not any person (including the children). An attorney can provide you with an opinion and advice which is in your best interest.
