Legal Question in Family Law in Texas

My neice is coming from WV to live with me in TX to finish high school to get a better education. Her parents are in total agreement in sending her here. What legal document do I need to be able to enroll her in high school?

Call the high school registrar and find out.

You might need legal custody.

It's up to the school district.

There is a new law that provides for an "authorization agreement" for a grandparent, sibling, for aunt or uncle. It will cover most anything that you need. The law is in Chapter 34 of the Texas Family Code. We have a form based on it that we use and it is MUCH less expensive that obtaining custody. There are some limitations (and penalties), so you should talk to an attorney before doing this.

While the form will authorize you to deal with health and education matters, it will not affect the admissions policies of the school district, so they may balk if they do not allow this situation.

Good luck.
