Legal Question in Family Law in Texas

My neice has given me and my husband her son to raise. We have a Child Custody power of attorney authorizing us to enroll him in school, make medical decisions, etc. Do we need to file this document with a court to make it legal?

If you've had the kit for more than 6 months, you need to get legal custody of him.

There are some new family law modifcations made by the TX legislature going into effect 9/1/09. I know that the issue of these powers of attorney for kids was addressed but I'm not exactly certain how the law is changed. I'm still learning about the changes going into effect in a couple of weeks.

Perhaps another attorney knows more than I do and can address this problem.
