Legal Question in Family Law in Texas

my niece

I have had my sister's child seen she came home from hosp. and I have had her 6 months already and CPS told me I could file Legal Custody when she turns 6 months but I don't know how

It's not surprising that you don't know how. i didn't know how when I got out of law school either. Have you asked CPS for assistance. I know they just helped a family client of mine to do all of the paperwork. If that doesn't work, try your local county bar association. Call the law library at the courthouse. They should be able to help you. While judge's offices and district clerk's offices might be able to help you, they're usually too busy. But it doesn't cost you anything to try. Good Luck.

You really need an attorney. Getting custody is not the simple thing that CPS has probably led you to believe it is. I really doubt CPS will be any help, if they were going to be, they would have already filed suit and not left it all on you. See if there is any legal aid available in your area. If not you will need to find a good family law attorney who will work with you on the costs. Good luck!
