Legal Question in Family Law in Texas

Over night visitation rights for fathers

Is there a law stating children under the age of three are not allowed to stay over night with the father for visitation? Visitation every other weekend for example, the child must go home at dark Friday and Saturday, and return in the morning.

Re: Over night visitation rights for fathers

No overnights for kids under 3 occur all the time in Texas.

However, visitation is one of those issues that can be adapted to each family's circumstances.

The Texas Family Code is available on line. I don't have my book with me so I can't tell you the section number. You can go to any search engine and find it.

Good luck!
