Non contested divorce
If the judge has already granted my mother and stepfather their divorce, but has informed her she will need to draw up a new judgement for him to sign. The original divorce degree was drawn by my stepdads attorney requesting a division of property. The judge awarded my mother everything but my step dads personal property. I paid for a divorce degree form online. However, it indicates a marital settlement agreement is to be attached. Is this needed if the judge awarded my mother everything but his personal property? They have nothing else to divide and they have no children. She can't afford to pay for an attorney to draw judgement. She is 63, retired and living on social security. I have a copy of the forms i purchased on findlegalforms, inc. But how do i eliminate the marital settlement agreement and word it correctly?

Basically, you are asking a lawyer on this board, to teach you how to practice law.
You don't know what you are doing, and there is great risk to your mother in continuing down this road. Please, either spend a great deal of time in the law library, or hire a lawyer to prepare the decree. It should not be expensive, but it is necessary. Good luck.
