Legal Question in Family Law in Texas

non costodial parent and grandparent rights

My Ex Boyfriend and I have been split up since i got Pregnant over 4yrs ago. He and his family denied my daughter and have never helped out raising her or even tried to see her. He took a DNA test and was ordered to pay child support which he doesnt and has been in jail for. Today his mother followed me my daughter and my son(from my marriage now) and my mother around a store. i asked her to stop that she had lost her privlages to my girl. she threatened me and said what goes around comes around. What kinda of Rights does she have in my case. Is there anything she could try to pull out of spite. I know her husband and her are alcoholics i know he has been arrested dont know about her tho. I would like to have all rights stripped from the childs dad and family and my husband gave her his last name and wants to adopt her. but we are not stable money wise. what can i do to stop them from trying to see her for now till i can get custody transfered to my husband when we have the money? thanks alot if you can help me.

Re: non costodial parent and grandparent rights

If her son is in prison, she can ask the court for visitaiton.

If her son is NOT in jail, then a grand parent has no rights.

Of course, she is free to hire an attorney and attempt to establish visitation. If she does, you would have to hire an attorney to fight her.

I hope this is helpful.
