Legal Question in Family Law in Texas

noncompliance with final divorce decree

My divorce was final February 2003. It was ordered for my ex to give me 1/2 of value of home. He was also to give me 1/2 of retirement and retirement proceeds. Upon his retirement (1-1-05), I received 1/2 of the monthly, but did not receive 1/2 of the lump sum money. I have still not received 1/2 of the value of our home. A petition for enforcement has been filed. Also, interragatories were served to him in which he had 30 days to answer. The answers still have not been forthcoming. How can this be enforced?

Re: noncompliance with final divorce decree

Your question indicates that you are represented by counsel. You should direct these questions to your attorney, as they are reasonable, and you have been extremely patient. If the decree is not specific enough to be enforced, then a clarifying order can be entered, and you can file for enforcement of that order. Hopefully this is helpful. If you do not have counsel, it would be wise to get an attorney, and you may well get an order reimbursing you for attorney fees. TCL
