Non-court filed agreement with biological father

My ex-boyfriend and I have a 3-month old and we

devised a child support and visitation agreement

between the two of us which we had notarized.

We have an amicable relationship at this point. I

had my will done and asked the attorney about

this agreement. He informed me that it isn't

considered legally binding until it is filed with the

court. My ex would then have to pay support to the

state which in turn would be paid to me. Why do

we have to go through the state?

The problem isn't paying money to the state. The problem is your ex can stop paying whenever he wants and there's nothing you can do about it. He hasn't even been legally declared the father of your child. That has to be done by a court, which then orders him to pay child support. Then you two can agree on how it will be paid.
